Introduction to the GPSCP Phase II Program
The Ghana Private Sector Competitiveness Program II (GPSCP II) is a program initiated through a bilateral initiative between the Swiss State Secretariat for Economic Affairs (SECO) and the Government of Ghana. This program is being implemented jointly by NIRAS International Consulting and Proforest. By building on the achievements of GPSCP Phase I, the second phase (GPSCP II) aims at continuously improving the enabling environment for the cashew and palm oil sectors and contribute to higher private sector productivity and competitiveness by fostering inclusive and sustainable growth through enhanced trade and competitiveness.
 
The GPSCP II will deliver its mandate using three implementation modalities:
 
1) Strategic Cooperation Partnership (SCP): To strengthen the Tree Crops Development Authority, the program will enter a strategic cooperation partnership. Guided by a Memorandum of Understanding, the program will support TCDA with its mandate of regulating the cashew and oil palm sectors and facilitate high-impact reform initiatives. This may include the development of strategies to facilitate finance and investment into the value chains among others, as well as internal organizational development.
 
2) Rapid Response Mechanism (RRM): The RRM is a fund, from which Ministries, Departments, and Agencies (MDAs) under the Government of Ghana can access finance to support and align reform initiatives that lead to a systemic benefit for the market systems of both value chains. The RRM can be used for a variety of activities around policy development and reviews to improve the speed and accuracy of developing private sector driven reforms, etc.
 
3) Development Partnership with the Private Sector (DPP): This matching grant fund is for the private sector to strengthen, processing, market linkages, service provision, sector associations, access to finance, and skills development in the cashew and oil palm value chains with counterpart contribution of the beneficiaries of the fund. The DPP also has the potential through its Call for Proposals mechanism to drive engagement and innovation through joint initiatives with the private sector, business associations or training institutions and co-finance the public good aspect such as innovation or sustainability in agricultural processing.
 
Purpose of Request for Proposal
The purpose of this Request for Proposals (RFP) is to solicit proposals under the Strategic Cooperation Partnership (SCP) modality from suppliers with expertise in law, forestry, agricultural commodities and/or natural resources management to conduct a policy and institutional mapping of stakeholders of the Tree Crops Development Authority established by the Act 2019 (Act 1010) and operationalized by Tree Crops Regulations, 2023 (LI 2471). The proposal is also expected to identify and evaluate investment constraints and reform opportunities with the tree crop sector in bid to meeting the strategic vision of the TCDA.
 
Institutions and Stakeholder Mapping
As clearly indicated under Miscellaneous Provisions, Section 23 of the Act 1010, there is the recognition that the Tree Crops Development Authority is required to collaborate with relevant institutions and bodies in the performance of its functions. This is because parts of its now mandated roles were played by other institutions. The Act 1010, 2019 goes on to identify and outline relevant institutions as including the Environmental Protection Agency, Ghana Cocoa Board, Ghana Investment Promotion Centre, the Ghana Export Promotion Authority, the Exim Bank Ghana, the Centre for Scientific and Industrial Research, the Food and Drug Authority and the Ghana Standards Authority.
 
Policy Mapping
The policies of the Ministry of Trade and Industry, Ministry of Local Government, Decentralization & Rural Development, and the Ministry of Food and Agriculture also directly influence the effectiveness of the TCDA in carrying out its mandate. A policy and institutional mapping is needed to provide clarity on the prevailing policy environment in which the Tree Crop Development Authority is expected to deliver its mandate and is key to attaining the goal of supporting the building of an enabling environment at a macro-level with special reference to the cashew and oil palm value chains.
 
Coherence and alignment with relevant governmental policies and initiatives remain crucial. Thus, the supplier will be required to, under the supervision of and in collaboration with the Deputy Chief Executive Officer, Operations of TCDA and the GPSCP II Secretariat, design and host a policy dialogue to offer better clarity on the policy environment in which the TCDA will work.
 
Business environment diagnosis
The growth and development of the tree crop sector is largely dependent on investments from the private sector as well as a complementary conducive business environment. While the policy mapping provides the foothold to addressing the misalignment and duplication of policies, it is important to identify key barriers that impede private sector growth and investments, that, in turn, require reforms to propel expanded investment activity. Benchmarking these policies and reforms in light of international good practice will encourage the creation of a transparent and attractive investment milieu to enhance private-sector-led development. The report will inform the design and scope of grant activities under the Rapid Response Mechanism.
 
Scope of work
The service provider will:
  • Design a conceptual framework for the policy and institutional mapping.
  • Conduct policy and institutional mapping with reference to the Tree Crops Development Authority
  • Provide a “snapshot” of the business and investment landscape of the sector, by identifying and evaluating business enabling constraints as well as reform opportunities with the tree crop sector.
  • Document and showcase international good-practice reforms, achievements and practices not only from government policymakers, regulators, and administrators, but also from private-sector actors in Africa and beyond.
  • Design and in collaboration with the TCDA, host at least one policy dialogue, with the participation of both private and public sector actors and development partners to discuss key findings.
  • Produce policy briefs and other communication materials with targeted messaging for identified stakeholders.
  • Support follow-up, monitoring, evaluation, learning and reporting on policy and institutional mapping and policy dialogue as necessary and appropriate.
  • Make recommendations for necessary policy development and alignment
Tasks
The service provider will:
  • Provide an overall assignment execution plan with milestones and timelines by 30th August, 2024
  • Participate in regularly scheduled progress check-ins with the TCDA and GPSCP II PMU
  • Draft report with reference to the TCDA by 20th September, 2024
  • A final policy and institutional mapping report with recommendations by 7th October 2024
  • Hold policy dialogue in collaboration with TCDA and GPSCP II Secretariat for all MDA stakeholders, private sector associations and Development Partners working in the cashew and oil palm value chains, by 18th October 2024
  • Draft report on Policy Dialogue by 25th October, 2024
  • Submit a final report on Policy Dialogue by 15th November, 2024.

Proposed Timelines

Inception Report

This will include stakeholder engagement meetings to understand the assignment. The inception report should provide consultant’s understanding of the assignment together with an overall assignment execution plan, milestones and timelines. The report should also indicate agreed mode of delivery for each task.

Complete a policy and institutional map with reference to the TCDA with recommendations.

Diagnostic analysis of the tree crops sector policy environment, opportunities for reform vis-à-vis TCDA’s vision and strategy

Analysis report of international best-practices, reforms (and achievements) from government policymakers, regulators, and administrators and private-sector actors in Sub–Saharan Africa.

Report on engagement of stakeholders based on outcomes of the policy and institutional mapping and facilitate policy dialogue with relevant MDAs, the private sector and Development Partners, in collaboration with TCDA and GPSCP II Secretariat.

Required Skills or Experience

Qualification of service provider:
  • Education: Advanced degree in law or public policy or similar. Experience in environmental policy and/or investment policy will be an added advantage.
  • Experience: Should have a minimum of 10 years of experience in facilitating multistakeholder processes such as policy development in the natural resources or agricultural sectors.
  • Skills: Should have strong analytical, writing and presentation skills.
  • Knowhow: Deep know how and understanding of Ghanaian laws and policies in the trade and investment, environment and tree crops sector.
